In the first session, Billy Seyffert will review the changes to the FAIS and insurance legislation and update you on developments since our last Regulatory Update Workshop. The agenda includes:

- The exemption that allows independent intermediaries to receive compensation, over and above commission, for performing activities that support the direct collection of insurance premiums.
- Crypto assets and the licensing of crypto asset providers.
- Clarifying the status of representatives.
- The Conduct Standard setting out the requirements relating to third-party cell captive insurance business.
- The draft Joint Standard on cybersecurity and cyber resilience.
- The Financial Intelligence Centre Act and anti-money laundering, which have received significant attention from both the Financial Intelligence Centre and the FSCA.
Billy will end the session with a quick update on where the industry currently finds itself and what changes can be expected in future.
Business email compromise
After the break, Andrea de Jongh will help you to understand what business email compromise (BEC) is, what your obligations are in terms of POPIA’s “security safeguard” processing condition, and what to do to avoid falling victim to such an incident.
A recent Gauteng High Court case, where the ruling found against a prominent law firm, indicated that sending bank details by email is inherently dangerous, and the interest of society demands that institutions recognise a legal duty to treat banking details as financially sensitive information, particularly where the risk of BEC can be foreseen.
Implications of the new earnings threshold
Then the attention shifts to the new earnings threshold announced by the Minister of Employment and Labour in terms of the Basic Conditions of Employment Act with effect from 1 March 2023. Andrea will help you to understand what the threshold is, what is meant by earnings, the practical implications for all employees, and how you should approach the current terms and conditions in your contract of employment templates.

The FSCA is hosting 2x Workshops in March, being 27 March & 30 March from 09h00 till 12h00 on each seperate date. Moonstone Workshop on 30 March 2023 clashes with the Workshop being held by FSCA.
Yes, we are aware of the FSCA workshop on 30 March. When I checked the registration link today, both FSCA workshops were fully booked. The FSCA usually posts its webinars on its YouTube channel, so it is possible to “attend” the Moonstone and the FSCA webinars – albeit that the FSCA webinar will not be live when you view it.
